Acceptance of Terms

By accessing or using the Chenghua.K Travel website (https://chenghuak.travel) and any related services, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not use our website or services. These terms apply to all visitors, users, and customers.

Use of Website

You agree to use our website only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the website. Prohibited behaviour includes:

  • Interfering with or disrupting the website, servers, or networks connected to the website.
  • Attempting to gain unauthorised access to any portion of the website or any systems or networks.
  • Using the website to transmit harmful code, spam, or unsolicited communications.
  • Copying, reproducing, or redistributing website content without our written permission.

We reserve the right to suspend or terminate access to the website for any user who violates these terms.

Bookings & Payments

All bookings are subject to availability and confirmation. Prices are quoted in Australian Dollars (AUD) unless otherwise stated and are inclusive of applicable taxes unless noted. A booking is only confirmed once we have received the required deposit or full payment and issued written confirmation.

The following booking terms and conditions also apply to shared group tours and related services:

1. Group Formation and Tour Confirmation Rules: This itinerary is operated as a shared group tour. If the minimum group size is not met and the tour cannot proceed, we will notify guests 3 days before departure and offer a full refund, rescheduling, or an equivalent-value package. For optional items that require advance booking, customer service will contact you in advance to confirm the prepayment process. If a traveller is late, absent on the day of travel, or leaves the tour early, it will be treated as a voluntary forfeiture. No refund or rescheduling will be provided.

2. Meeting Time and Late Arrival Policy: To protect the interests of all passengers, guests on shared tours must arrive at the designated meeting point on time or 10 minutes early. As the driver-guide cannot remain waiting in public areas for an extended period, late arrivals will be treated as voluntary forfeiture. No refund or rescheduling will be provided in such cases.

3. Children and Infants Policy (Strictly Enforced Under Australian Traffic Law): Children aged 3-12 travelling with adults are charged at the adult rate and must occupy a seat. Under Australian traffic law, all children and infants under 7 years old must use an approved child restraint. Infants aged 0-2 must contact customer service in advance and pay the applicable seat fee and child-seat rental fee of AUD 30 per day. For children aged 3-7, if their height or weight does not meet the legal standard and a child restraint is required, please notify customer service when booking. If this is not declared and it causes vehicle overloading or a traffic law breach, the driver-guide has the right to refuse boarding and any resulting loss will be borne by the guest.

4. Luggage Allowance: Due to vehicle type and limited luggage space on shared tours, guests carrying large suitcases, such as 24 inches or above, must inform customer service at the time of booking.

5. Vehicle, Guide Assignment, and Language: Based on the final group size, we will assign an appropriate vehicle, such as a 5-25 seat business vehicle or a medium-to-large coach. Unless a specific product states otherwise, day tours and multi-day tours are generally operated in driver-guide mode with Chinese-language service.

6. Tickets and Optional Items: Optional attraction tickets marked as requiring advance booking must generally be purchased through the travel agency. Items that do not require advance booking can be paid on site by guests. To ensure itinerary coordination and fairness, guests may not bring self-purchased tickets for optional attractions bought in advance from other platforms. If guests insist on using their own tickets, they must pay the corresponding transfer service fee or vehicle fare difference on site. Please contact customer service for the exact amount.

7. Itinerary Changes and Guest Conduct: Once you join the tour and the itinerary begins, all activities have already been arranged. If you request itinerary changes on the day of travel, additional costs or unnecessary losses may result. Guests must follow the guide's arrangements throughout the trip. If a guest's words or actions disturb other travellers or prevent the itinerary from continuing, including illegal conduct, violence, or seriously uncivilised behaviour, we reserve the right to terminate service immediately. The remaining tour fee will not be refunded, and the guest is solely responsible for their own safety and return arrangements.

8. Hotel Accommodation Notes (If Accommodation Is Included): If the itinerary includes hotel accommodation, all prices are based on two people sharing one room, either a standard twin room or one double room. Solo travellers must pay the single supplement. If three guests wish to share one room, usually with an extra bed or family room, please contact customer service in advance to confirm room type and any price difference.

9. Force Majeure Disclaimer: In the event of weather, war, strikes, flight delays, mechanical failure, road conditions, temporary attraction closures, or any other special or unavoidable circumstance beyond human control, we reserve the right to cancel, adjust, or replace any part of the itinerary before or after departure, and to shorten or extend the journey. Any additional expenses or losses arising from such circumstances are not the responsibility of our company. We reserve the right to adjust the itinerary according to actual conditions.

10. Safety, Insurance, and Loss of Property: This product does not include personal travel accident insurance. Guests are strongly advised to purchase their own insurance. Travel safety in Australia is covered by the commercial insurance held by the relevant transport operators, hotels, and attractions, and our company does not assume direct liability for compensation. In the event of lost property, damaged luggage, personal injury, or accidental death during the trip, we will assist in resolving the matter in accordance with Australian transport laws and tourism regulations, and we will cooperate with insurance claims, but we do not bear direct losses. For your own protection, we strongly recommend purchasing overseas personal travel accident insurance before departure.

Cancellations

The following cancellation policy applies unless otherwise specified in your booking confirmation:

  • Pink Lake Cabin 2-Day Tour and Kangaroo Island 2-Day Tour: Once the itinerary is confirmed, it cannot be cancelled and no refund will be provided, as ferry tickets, accommodation, and related arrangements are involved.
  • Other one-day tours: Cancellations made more than 7 days before departure and within 10 days before departure, inclusive, incur a 20% charge of the total price.
  • Cancellations made more than 72 hours before departure and within 7 days before departure, inclusive, incur a 50% charge of the total price.
  • Cancellations made within 72 hours of departure, no-shows on the departure day, or guests who leave early will be charged the full amount.

Refund processing times may vary depending on the original payment method and third-party providers.

Intellectual Property

All content on this website, including text, images, logos, graphics, videos, itineraries, and software, is the property of Chenghua.K Travel or its licensors and is protected by Australian and international copyright, trademark, and other intellectual property laws. You may view and print pages for personal, non-commercial use only. Any other use, including reproduction, modification, distribution, or republication, without our prior written consent is strictly prohibited.

Limitation of Liability

To the maximum extent permitted by law, Chenghua.K Travel and its directors, employees, agents, contractors, and partners will not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or enjoyment, arising out of or in connection with your use of the website or participation in our tours. This limitation does not apply to liability that cannot be excluded under the Australian Consumer Law.

Indemnification

You agree to indemnify, defend, and hold harmless Chenghua.K Travel and its officers, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or in connection with your use of the website, your breach of these terms, or your violation of any law or the rights of a third party.

Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the State of South Australia and the Commonwealth of Australia. You irrevocably submit to the exclusive jurisdiction of the courts of South Australia for any dispute arising out of or relating to these terms or your use of our services.

Changes to Terms

We may revise these Terms of Service at any time by updating this page. Changes take effect immediately upon posting. Your continued use of the website following any changes constitutes acceptance of the revised terms. We encourage you to review this page regularly.
